In March 2005, ELQUI was found with baited lines ready to fish in South Georgia waters, after being intercepted by a Fisheries Protection vessel, SIGMA. After being escorted to Stanley harbour and impounded, her master and owners were tried in Stanley by the government of South Georgia and South Sandwich Islands and found guilty. They were fined more than £300,000, to be paid in seven days. The penalty was not paid and the ELQUI was seized by the South Georgia Government. She was stripped of all oils and thoroughly cleaned before being scuttled near Shag Rocks, off Lively Island in East Falkland on 6th October 2005.
